Pune Porsche Crash: Accused Teen’s Mother Shivani Agarwal Walks Out Of Jail; Here’s Who Is Still Behind Bars

Shivani Agarwal, mother of the teenager involved in the Pune Porsche crash that claimed two lives, walked out of jail on Saturday, four days after the Supreme Court granted her interim bail. She is the first among the ten arrested in the alleged blood sample-swapping case to secure release on bail.

The tragic incident occurred in the early hours of May 19 last year, when a Porsche allegedly driven by a 17-year-old boy in an inebriated state fatally knocked down two IT professionals on a two-wheeler in Pune’s Kalyani Nagar. Following the crash, Shivani Agarwal was accused of attempting to shield her son by swapping her blood sample with his to conceal his intoxication levels.

While granting interim bail, the Supreme Court directed the Pune district and sessions court to set the bail conditions. Special Public Prosecutor Shishir Hiray, representing the state, had sought stringent conditions, including barring Agarwal from staying in Pune district, seizure of her passport, mandatory police station attendance, and mobile location tracking.

During the hearing, advocates Angad Gill and Dhvani Shah, appearing for Agarwal, successfully argued against the condition restricting her stay in Pune, citing her husband’s custody and the necessity of her presence to assist in legal proceedings. They also objected to proposals for a high surety amount and daily police reporting.

Additional Sessions Judge Amol Shinde rejected the prosecution’s plea to prevent her from staying in Pune but accepted the other conditions. As per the bail order, Shivani Agarwal must submit her passport to the investigating officer, share her mobile tower location, report to the police station every Wednesday, refrain from leaving India without court permission, and not disclose her identity for the next three months. A personal bond of Rs 1 lakh was also mandated.

Meanwhile, nine other accused remain behind bars. These include the minor’s father Vishal Agarwal, Sassoon General Hospital doctors Ajay Tawre and Shreehari Halnor, hospital staffer Atul Ghatkamble, two middlemen Ashpak Makandar and Amar Gaikwad, and three others — Aditya Avinash Sood, Ashish Mittal, and Arun Kumar Singh. Notably, Sood and Singh are fathers of the other two minors who were present with the teenage driver during the crash, and Mittal is Singh’s friend. All are implicated in the alleged swapping of blood samples.

Earlier, the Bombay High Court had observed that the remand orders for the minor driver were passed in an “absolutely illegal and mechanical manner” and ordered his release from the observation home in Yerawada. The court placed him under the supervision of his paternal aunt, with directions for rehabilitation as per the Juvenile Justice Board’s guidelines.
