Pune Porsche Case: Shivani Agarwal, Mother of Accused Teen Gets Interim Bail

In a major development in the high-profile Pune Porsche case, the Supreme Court on Tuesday granted interim bail to Shivani Agarwal, mother of the teenager accused of killing two techies in a drunk driving incident in Pune’s Kalyani Nagar last year.

The relief came as the apex court reserved its final order on a petition challenging the legality of her arrest, which took place after it was confirmed that her blood samples had allegedly been swapped with her son’s in an attempt to mislead investigators.

The crash, which occurred on May 19, 2024, claimed the lives of two IT professionals when the teen, reportedly under the influence of alcohol, crashed a Porsche into their two-wheeler.

Shivani Agarwal, the teen’s mother, has spent approximately 10 months in custody. Her counsel argued that she was not informed of the grounds for her arrest at the time, violating legal procedures. They further invoked provisions under the Code of Criminal Procedure (CrPC) that offer protection to women during arrest.

The Supreme Court acknowledged that a chargesheet had already been filed and the matter primarily involved allegations of evidence fabrication. While noting that several similar petitions concerning arrest protocols are pending, the court allowed interim relief in her specific case.

The apex court’s interim order has brought temporary relief to Agarwal, but a final verdict on the legality of her arrest is still awaited.

The case remains under public scrutiny due to its sensitive nature involving a minor, allegations of influence misuse, and the tragic loss of two young lives.
